2023/2024 Parent Hebrew School Agreement

REQUIRED INFORMATION
1. I understand that in order to secure a place for my child in Cett Hebrew School (“Cett”), I must agree to the terms and conditions of this Hebrew School Parent Agreement and my application needs to include all of the following:
A. Online Hebrew School enrollment completed with accurate and up to date information.
B. A $125 non-refundable deposit. Please refer to the Refund Policy below. 
C. Submit payment information for full payment or payment plans as outlined in the Hebrew School enrollment.
2. I understand that Cett will not hold a spot for my child if the deposit and/or full payments are not received or have not been set up in my Hebrew School account.
 

COMMUNICATION
1. I understand that Cett communicates with parents primarily via email and mobile phone messages and notifications. I have provided a working email address which I check frequently, I authorize Cett to send me and other parents/guardians on my account, Hebrew School related information via this email address. I agree to receive Hebrew School text messages and notifications to my mobile device of which I have provided the mobile number for. I will also download the Hebrew School app if applicable, sign up to my child's class messaging group, and enable notifications.
I understand that when Cett sends an email or message, it assumes that I have received and read the notification in its entirety. Cett further assumes that if I have a question I will contact the Cett office by email asap to get clarification. I understand that the longer I wait to ask a question or share a concern, the less likely Cett will be able to have a timely and favorable response. Cett will not be held responsible if I miss notifications due to filters or glitches, if I overlook an email or message, if i don't read the communication in its entirety, or any other computer/device or non-computer related issue.
2. I understand that it is my responsibility to notify Cett immediately upon email address or phone number change, or if I see that I have not received any Cett related emails or messages leading up to a few weeks before the beginning of my child's Hebrew School session. I will also check my spam folder and adjust my email settings to ensure I am receiving the Hebrew Schools emails.
3. If required by law, I agree to complete a health log each day before my child enters Hebrew School. I agree to notify Cett immediately if my child tests positive for Covid, exhibits any Covid symptoms, has a fever in excess of 100.4 degrees; or lives in a household in which a household member tests positive for Covid, exhibits any Covid symptoms or has a fever in excess of 100.4 degrees; or otherwise comes into contact with anyone who contracts Covid, exhibits Covid symptoms or tests positive for Covid.

TUITION POLICY
1. I agree to pay the full amount of the Hebrew School tuition per child, as stated on the Hebrew School website, as well as any additional charges for voluntary activities or programs if they are offered, unless I have entered into a written tuition agreement signed by both myself and the Cett director that indicates otherwise.
2. I agree to pay a $30 returned payment fee for each individual Credit Card charge disputed or unpaid by my card company or bank, check, or E-Check that is returned from the bank unpaid. I understand that this fee will be applied to my Hebrew School account and I will be obligated to pay it immediately together with the amount of the original balance.
3. I understand that after the Hebrew School year is over, my account will be reviewed. If there is an outstanding balance that is not part of a payment plan, my method of payment (E-Check or Credit Card) will be used to collect payment for the amount due at that time.
4. The Hebrew School office will send me an email with my balance before any charge is made. I will then have up to three days from the date of the email to review my account with the office staff to ensure accuracy. If I have not contacted the Hebrew School office within three days after the email, I authorize my account to be charged as described above.
REFUND POLICY
1. Cett will not offer and parents/students will not be entitled to any refunds or deductions from tuition for any reason including, without limitation: 
A. arriving late, leaving early, vacations, holidays, missed days, sick days for any health reason, suspension/expulsion from Hebrew School; 
B. if Hebrew School is suspended or closed due to a Covid outbreak or any other health or pandemic related reason, or due to government suspension or closure of Hebrew School; 
C. if a student contracts COVID-19, displays Covid symptoms, fails to pass the daily health screening whether related or unrelated to Covid, or if other students or staff contract COVID-19; 
D. if a student is otherwise unable to attend Hebrew School or participate in Hebrew School activities for any reason. 
2. There is a $125 non-refundable deposit when you submit an enrollment. If you have credit with Hebrew School, it may be used for deposit, and is also not refundable, or transferable as credit once your enrollment has been submitted. If Hebrew School doesn't open for any reason, the deposit will not be refunded.
3. If Hebrew school is forced to go online for any reason, tuition will remain the same, Hebrew School payments will continue, and no refunds or credits will be given.
4. I understand that by enrolling to Hebrew School a spot will be held for my child, including set up of classes, purchasing of supplies and more, therefore we have adopted the following Refund Policy.
Up to September 1 of the current year full balance can be refunded minus deposits.
Up to September 1 prior to the start of school 50% refund minus deposit will be made.
After September 1 prior to the start of school no refund will be made.
5. If you need to cancel your enrollment before school begins, we ask you to please let us know immediately so that we can stop your scheduled payments. All payments, once charged to your account cannot not be refunded.
 

ARRIVING EARLY, PICKING UP LATE POLICY
1. I understand that supervision will not be available before Hebrew School or after Hebrew School, and that I cannot drop off my child earlier than 9:50am.
2. I further agree to ensure timely pick up of my child from Hebrew School, no later than 12:30pm.

RELEASE
1. I give my child permission to participate in all Hebrew School activities and trips. I allow my child to be transported by Cett Hebrew School to school trips and outings. By registering my child to Cett I attest that my child is physically, emotionally, and socially capable in every way of participating in the Hebrew School's classroom environment, programs and activities. I further agree that Cett's willingness to accommodate me and/or my child for a special need or request does not obligate Cett to continue to do so or do so again. It further does not absolve me from my responsibility to ensure that Cett and the Cett program is suitable for my child. Cett is not responsible to inform me of any doubts that staff or administration may have about my child's ability to participate in the program. However Cett in its sole discretion may refuse, suspend, or expel my child with no refund based on Cett determination of his or her inability to participate in the program.
2. I allow my child to be in photos and videos taken by and/or produced by Cett and Cett's affiliates, and I allow videos and pictures of my child to be used on the websites and social media pages of Cett and Cett's affiliates and in print.
I understand that Cett cannot and does not guarantee that no student will become ill or infect others. I understand that Cett will do its best to follow the applicable state guidelines, including but not limited to social distancing, frequent hand washing, and sanitizing implemented and encouraged frequently and as much as possible.  
I acknowledge that transmission of pandemics, epidemics, airborne diseases, and other communicable diseases, including but not limited to COVID-19, are outside of the Hebrew School’s control and occurring without its fault or negligence.  I further acknowledge that there is an inherent risk in contracting COVID-19 and other communicable or airborne diseases despite compliance with applicable guidelines.  I understand that by enrolling and sending my child to Cett, I assume the risk of infection from COVID or other communicable diseases despite the efforts and precautions that Cett will implement.
3. I understand that Hebrew School involves classroom and other activities, social and other interactions, and responsibilities some of which may be new to my child. I understand that these come with certain risks and uncertainties beyond what my child may be used to dealing with and beyond what Cett may control. I am aware of these risks and I am assuming them on behalf of my child who is a minor. I realize that no environment is risk-free and/or 100% safe. Therefore I assume the responsibility of all costs, medical expenses or any other damage or suffering that may result from participating in Cett, or an injury or incident at Hebrew School. I will not hold the Hebrew School responsible for any medical or other expenses I may incur due to my child attending and participating in the program at Cett. I realize that some situations may not be covered by my insurance or the Hebrew School's insurance, and that some situations may be specifically excluded by my or the Hebrew School's insurance. I will not hold the Hebrew School responsible for any medical or other costs or expenses I may incur due to my child attending and participating in the program at Cett.
4. I acknowledge on my own behalf and on behalf of my child that Cett is not liable to me or my child, student, jointly, severally, or individually, and I agree to forever release and waive Cett and each of its owners, affiliates, vendors, employees, agents, representatives, successors, or assigns from any and all claims or causes of action regarding harm or injury  arising from or related to COVID-19, the contraction of the coronavirus or other communicable diseases, or other injuries outside of Cett’s reasonable control.  I agree to voluntarily give up, relinquish, or waive any right that may otherwise exist to bring a legal action against the Hebrew School for personal injury or property damage.  To the extent that statute or case law does not prohibit releases for negligence, this release is also for any claims or causes of action for negligence in New Jersey or any other jurisdiction.  I make this release on my own behalf and on behalf of my minor child. I acknowledge that I have carefully read this provision and understand that it is a release of liability.  
I have instructed my child on the importance of proper behavior and abiding by Cett's rules. My child and I both acknowledge that he or she is familiar with these rules and will obey them.
5. I agree, on my own behalf and behalf of my child, to follow at-home guidelines to help contribute to a safe environment at Hebrew School, including but not limited to the following:  
A. Follow all state guidelines issued with regard to Covid safety; 
B. I understand that it is advised that I should consult my child's medical provider to assess risk and determine if attending Hebrew School is acceptable for my child and/or the implications of my child attending Hebrew School to the people living in my home; 
C. I will talk to my child and explain the importance of following Cett's guidelines with regard to social distancing, frequent hand-washing, sanitizing and covering of the face at appropriate times.
9. I agree that my child will: 
A. Not attend school if they are sick or experiencing any flu-like symptoms; 
B. Wash or sanitize hands upon entry to Hebrew School.
C. Practice good hygiene by coughing or sneezing into their elbow or a tissue, and avoid touching your mouth, nose, and eyes;
D. Maintain physical distance with other persons when possible.
E. Wear a face mask when possible and applicable at Hebrew School.
G. Follow hand hygiene and cleaning and disinfection guidelines, including but not limited to frequently washing and sanitize hands; 
H. Report symptoms of or exposure to COVID-19 to Cett.   
10. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
GENERAL RULES AND POLICIES
Cett has policies in place to help each student gain as much as possible from the Hebrew School experience. A copy of Cett's student rules and health, safety and disciplinary policy are available on the Cett website. My signature on the enrollment which references this agreement indicates my consent to abide by all of Cett's rules, regulations and policies.
I understand that Cett is not equipped or staffed to accommodate children with special needs of any kind including difficulty with social skills, any form of ADD or ADHD, impulsive behavior, or emotional distress, as well as the inability to participate in self-regulating behavior.
I understand that Cett does not evaluate children before or during Hebrew School and has no way of professionally diagnosing the status of a child. I agree that Cett in its sole discretion as based on my child's behavior, determines my child's ability to participate in the program, but has no responsibility to inform me of any such determination. I understand that Cett will not be held responsible for injuries or distress of any kind due to the inability to care for a child with any form of special need described above. I am fully aware that Cett cannot properly care for children with special needs. By registering my child with Cett I vouch that my child has the necessary abilities to participate in a mainstream program and I assume responsibility for any form of injury and all costs associated. I also forfeit a refund in the case my child is dismissed from Hebrew School due to not being able to participate in the program as deemed solely by Cett.
I will notify Cett immediately of any physical concerns, limitations, or diagnosis that my child may have or develop before or during the current Hebrew School season, as well as any medical diagnoses that may be new for this Hebrew School season.
Cett reserves the right to, in its sole discretion, remove any student from Hebrew School for reasons it believes are in the best interests of the Hebrew School and the children enrolled. Should a student be sent home for any such reasons, no refund will be made.
I will keep my general contact information and emergency contact information current with Cett. I will notify Cett immediately of any change in my contact information.
I will pay for any damage done by either my child acting alone or in concert with others to Cett property and/or property of any facilities, equipment, or vehicles on our property.
Neither Cett nor any of its staff shall be responsible for the loss of or damage to the personal property of the student. I agree to ensure that my child does not bring expensive belongings to Hebrew School.
I understand that my child will not be allowed in Hebrew School if they do not pass the daily health screening, and will be suspended from Hebrew School if they display symptoms of Covid, have been in contact with anyone who has been sick with or had symptoms of Covid in the past week. This suspension can range up to two weeks, depending on the circumstances of the exposure of your child, and on two consecutive negative tests for Covid. I understand that my child will only be allowed to return to Hebrew School after a week of quarantine, and a negative test for Covid.
I understand that Hebrew School is run by people, teachers, admins and volunteers, and those people will work hard to keep Hebrew School safe and fun. I understand that these people deserve the same respect and courtesy that any other person deserves. The people at Hebrew School will always treat me and my child with respect, and the same is expected in return.
I understand that caring for other people's children is always difficult and requires a huge degree of care and responsibility, even in normal times, and even more so in the time we find ourselves in now. I agree to respect that level of care and trust.  If I have a question, a disagreement, or a concern, I will address it directly with the Hebrew School office or directors, by way of email or private message. I understand that while in the event of a disagreement or misunderstanding I have with the Hebrew School, I may feel better by venting to my friends online or offline, but this is not how I will help my child or myself resolve the issue. Rather, I understand that by having direct and immediate communication with the Hebrew School office and/or directors with the intention of resolving the matter asap, this will best benefit my child and other children at Hebrew School.
I agree to abide by the decisions that the directors of Cett make, I understand that these decisions will always put the safety of the kids first. I further agree to bring up any disagreements I have with these decisions, or questions I have in a respectful manner, and in private, just like I would expect when the Hebrew School communicates with me.
 
NO ABUSE POLICY
Cett has a no abuse policy and will not tolerate children using any form of abuse whether verbal or physical against another student or staff member. All children engaging in any form of abuse or bullying, (irrelevant of who started) will be subject to disciplinary action, which may consist of some or all of the following and not necessarily in this order:
A warning from the class teacher, a talk with the Cett director, a phone call home informing parents of the situation, or suspension from Cett. Cett will do its best to prevent and minimize any form of abuse. I understand that Cett will not be held responsible if abuse does occur and I release Cett from any responsibility in case my child suffers any form of abuse at the hands of another student or staff member. See also the safety and disciplinary policy and Hebrew School behavioral agreement and student code of conduct for more specific information.
MEDICAL INSURANCE
Cett shall not be responsible for the cost of any medical, health or dental treatment relating to participating and/or attending Cett. I understand that no environment is 100% risk free despite best practices of Cett. I understand that I am required to have medical insurance with adequate coverage for the risk that sending my child to Hebrew School involves. I take responsibility for any and all expenses, medical or otherwise, resulting from an injury while attending Cett, and work with my insurance to get it paid without involving Cett in any way. I understand that my child, myself or someone in my family may get sick with Covid or any other disease during the time my child is enrolled in Cett, as a result of attending. I have the necessary health insurance to make sure that my family and I can get the medical treatment we may need to pay for. I understand that some insurance policies may exclude pandemic related events, and that while I am covered for general medical expenses, not all medical expenses may be covered, and non-medical expenses may not be covered at all.

Permission to treat authorization

My child has permission to participate in all school activities except as noted on the enrollment. I give permission to Cett Hebrew School and/or the physician selected by the school to order x-rays and treatment related to the health of my child for emergency situations. If I cannot be reached in an emergency, I give my permission to Cett Hebrew School and/or the physician to hospitalize, secure proper treatment for, and order injection, anesthesia, or surgery for this child. I agree that information on the enrollment be used as necessary for treatment, referral, billing or insurance purposes, be shared and/or released on a 'need to know' basis with school staff and/or health care professionals. In addition, the school has permission to obtain a copy of my child's health record from providers who treat my child and these providers may talk with the program's staff about my child's health status.

It is my intention that representatives of the school be considered 'personal representatives' for the purpose of disclosing health information that is protected under the Health Insurance Portability and Accountability Act of 1996. I also agree to the disclosure to school representatives of protected health information of the person named herein in order to provide information related to the person's ability to participate in school activities; and if the person enrolled is a minor, to provide information to the school representatives to keep me informed of my child's health situation.

In the event that I cannot be reached in an emergency, I hereby give permission to the physician selected by the school director to secure and administer treatment, including hospitalization. My child's health information may be taken along on trips out of school.


WAIVER OF TRIAL, AND AGREEMENT TO ARBITRATE
In the event that there are any disputes regarding the Parent Hebrew School Agreement, I, on my own behalf and on behalf of each enrolled child, waive any right to a trial in a court of law before a judge and jury.  I, on my own behalf and on behalf of each enrolled child, agree that any such dispute shall be brought no later than ninety (90) days after the last day of Hebrew School of the current school year, and will be determined by binding Arbitration before one (1) arbitrator with experience in the non profit/Hebrew School industry to be selected by Cett, and that such arbitrator shall certify that the arbitrator is free from any conflict of interest. I, on my own behalf and on behalf of each enrolled child, further agree that the arbitration will take place solely in the State of New Jersey and that the substantive law of New Jersey shall apply, and that if I seek to assert a claim against Cett on my own behalf or behalf of my child, I will notify Cett in writing with a demand for arbitration.  To the extent that any claim I have against Cett has not been released or waived by this Agreement, I acknowledge that I have agreed that my sole remedy is to arbitration of such claim, and that such claim may only be brought against Cett in accordance with the above Waiver of Trial, and Agreement to Arbitrate.
AGREEMENT
I understand that by submitting the enrollment referenced in Section 1(A) under 'Required Information,' I have agreed to abide by all of the terms and conditions of this Hebrew School Parent Agreement and all policies outlined in the parent handbook and other documents Cett has made available to parents. I have read about what Hebrew School may look like in the current school year, I have read the risks, I understand them and I assume them on behalf of my child and myself.
I understand that if I am not comfortable with any of these agreements, if I disagree with them, or if I have a hard time keeping my disagreement with Hebrew School off of social media or discussing them with my friends, I should strongly consider not participating for the current school year.
I acknowledge that I have read the entire document and that I understand all terms and conditions.  
By signing my name on the parent agreement on the enrollment form, I acknowledge my understanding of its content and that this document cannot be modified orally.
I and each enrolled child agree to abide by Cett’s policies and procedures, as well as any other rules and regulations, as may be adopted or amended from time to time.
